1. Definitions
For the purposes of these Terms & Conditions:

Warisan International Martial Arts Academy ("Warisan"): the business entity offering products via its webshop or other sales channels.

Customer: any natural or legal person who enters into an agreement with Warisan or places an order.

Consumer: a customer acting for purposes outside their trade, business, craft, or profession.
-
Agreement: any contract between Warisan and the customer for the purchase and delivery of products or services.
-
Product: any physical or digital good offered by Warisan.
2. Applicability
-
These Terms & Conditions apply to all quotations, offers, activities, orders, agreements, and deliveries of products or services by or on behalf of Warisan.

Deviations from these Terms are valid only if expressly agreed in writing by Warisan.

The applicability of any general terms and conditions of the customer or third parties is hereby expressly excluded.

By placing an order, the customer declares full acceptance of these Terms & Conditions.
3. Prices
-
All prices are stated in euros (€) and include VAT, unless otherwise specified.
-
Additional charges such as administration, shipping, or handling fees are communicated before the Agreement is concluded.

Warisan reserves the right to adjust prices at any time, except for confirmed orders already accepted.
-
Price increases resulting from statutory changes (e.g., VAT adjustments) do not entitle the customer to terminate or claim damages.
4. Payment
-
Warisan may require full advance payment (100%) before processing or shipping an order.
-
Orders are not dispatched until full payment has been received.
-
Upon receipt of payment, Warisan will issue an electronic or written confirmation of the order.
-
If payment is not received within the specified period, the customer is automatically in default, and Warisan may suspend or terminate the Agreement.
5. Right of Withdrawal (Consumers Only)
-
A consumer has the right to withdraw from an online purchase within 14 days of receiving the product, without stating any reason, provided that:
-
the product has not been used or damaged;
-
the product was not custom-made or personalized;
-
the product is returned in its original condition and packaging.
-
-
The 14-day cooling-off period begins on the day after the customer receives the product.
-
The customer must notify Warisan in writing of the withdrawal at info@warisanmartialarts.com within this period.
-
The customer bears the costs and risk of return shipping. All returns must include a Track & Trace code.
-
After timely and correct return, Warisan will refund the purchase price (excluding original shipping fees) within 14 days.
-
The right of withdrawal does not apply to:
-
personalized or custom-made products;
-
digital content once delivery has started with customer consent;
-
hygiene-sensitive items with broken seals.

6. Delivery
-
Delivery takes place while supplies last.
-
All delivery times are indicative, not binding. Delays do not entitle the customer to compensation or cancellation unless expressly agreed in writing.

Products are shipped to the address provided by the customer.
-
The risk of loss or damage transfers to the customer once the goods are handed over to the carrier.
-
Warisan is not liable for losses or delays due to incorrect or incomplete address information provided by the customer.
7. Retention of Title
-
All products remain the property of Warisan until full payment of all outstanding amounts (including fees and interest).
-
The customer may not sell, pledge, or otherwise transfer ownership of unpaid goods.
-
In the event of non-payment, Warisan may terminate the Agreement and reclaim the goods without any obligation to refund or compensate the customer.
8. Warranty
-
Warisan guarantees that products meet reasonable standards of quality and usability.
-
The warranty applies only to manufacturing or material defects and excludes:
-
normal wear and tear;
-
damage caused by misuse, negligence, or modification;
-
damage resulting from external causes beyond Warisan's control.

Warranty claims must be submitted in writing within 14 days after the defect is or could reasonably have been discovered.
9. Exchanges
-
Exchanges are possible only within 14 days of receipt and under the following conditions:
-
the product is unused and undamaged;
-
all original packaging and tags are intact;
-
the original invoice is presented.
-
-
Discounted, custom-made, or special-order products cannot be exchanged or returned.
10. Liability
-
Warisan is liable only for damage caused by intent or gross negligence.
-
Any liability is limited to the amount covered by its professional liability insurance, or, if none applies, to the invoice amount of the relevant transaction.
-
Warisan is not liable for indirect or consequential damages, including loss of profit, data loss, or third-party claims.
-
All products sold are used at the customer's own risk.
-
Participation in any physical activity, seminar, or training mentioned in marketing materials or descriptions is at the participant's own responsibility. Warisan and its instructors are never liable for injuries or damages of any kind.
11. Force Majeure
-
"Force majeure" refers to any circumstance beyond Warisan's reasonable control that prevents or delays performance, including but not limited to:
natural disasters, fire, flooding, war, government actions, strikes, power or internet failures, transport interruptions, pandemics, or supplier default. -
In such cases, Warisan's obligations are suspended for the duration of the impediment.

If the situation persists for more than 30 days, Warisan may terminate the Agreement in whole or in part without liability for damages.
12. Complaints Procedure
-
The customer must inspect delivered products promptly upon receipt.
-
Complaints must be reported in writing within 14 days of discovery via info@warisanmartialarts.com, including a detailed description of the issue.
-
Untimely complaints will not be considered.
-
If a complaint is found valid, Warisan may, at its discretion, repair, replace, or refund the product (in whole or in part).
13. Liability Concerning Training Materials
Note: The provisions in this article apply solely to the use of training products or materials purchased through the webshop.
Participation in martial-arts lessons, seminars, or live training sessions is governed by separate terms available under "Member Terms & Training Regulations – Warisan International Martial Arts Academy."

The use of training weapons, protective gear, or any equipment purchased from Warisan is entirely at the customer's own risk.
-
Warisan and its instructors cannot be held liable for injuries, losses, or damages arising from the use or misuse of such materials, even if alleged to result from defects or improper instructions.

By purchasing and using these items, the customer waives any and all rights to hold Warisan or its staff legally responsible in any form whatsoever.
14. Amendments
-
Warisan reserves the right to amend or supplement these Terms & Conditions at any time.

Minor modifications may be made without prior notice; substantial changes will be announced via the website.

The most recent version is always available at www.warisanmartialarts.com.
15. Governing Law & Jurisdiction
-
All Agreements, deliveries, and disputes are governed exclusively by Dutch law.
-
Any disputes shall be submitted to the competent court in The Hague, The Netherlands, unless mandatory law stipulates otherwise.
