Member Terms & Training Regulations

1. Scope of Application
-
These Member Terms & Training Regulations apply to all members, students, and participants of any training, seminar, workshop, or event conducted by Warisan International Martial Arts Academy (hereinafter: Warisan).

By registering, participating, or attending any Warisan activity, the member explicitly acknowledges and accepts these Terms in full.

These Terms are binding upon all members, regardless of age, level, or membership duration.
2. Enrollment & Evaluation Period
-
New students are required to complete an introductory and evaluation period of approximately six (6) weeks before full membership is granted.
-
This period allows Warisan to assess the student's discipline, commitment, attitude, and suitability in accordance with the Academy's principles.

Upon completion, Warisan reserves the right to determine whether the student may continue as a full member.

If the student is deemed unsuitable or unfit for the program, participation may be terminated immediately.
-
All decisions made by the head instructor (Guru Marcel Horstman) are final and not subject to appeal.
3. Payments, Attendance & Restitution
-
Membership fees secure the student's placement within the training program and are not based on individual attendance.
-
No refunds, credits, or transfers will be provided under any circumstance, including but not limited to:
-
illness, vacation, work commitments, or personal reasons;
-
voluntary withdrawal from the program;
-
lack of attendance or motivation.

All payments must be made on time and in full to maintain active membership status.

Temporary absence does not suspend payment obligations, unless explicitly agreed in writing by Warisan.
4. Instructor Absence & Continuity
-
In the event that the head instructor (Guru Marcel Horstman) is unable to conduct a class due to illness or unforeseen circumstances, Warisan will ensure training continuity by:
-
appointing a qualified replacement instructor, or
-
rescheduling the session to another suitable date.

If two (2) or more consecutive sessions are cancelled, the missed hours will be combined into a compensatory seminar or extended session, free of charge for the affected members.

Members will be informed of such adjustments in advance whenever possible.
5. Conduct, Discipline & Ethics
-
Every member must maintain a standard of respect, discipline, humility, and self-control at all times.
-
Aggressive, disrespectful, or disruptive behavior toward instructors, students, or the Academy will result in immediate termination of membership without refund.

Warisan enforces a zero-tolerance policy regarding violence, discrimination, harassment, or misconduct in any form.
-
Members are expected to uphold the values and reputation of Warisan both inside and outside the Academy.
6. Termination & Notice Period
-
A member may terminate their participation at any time, by submitting a written notice (via email or signed letter).
-
All memberships are subject to a one (1) full calendar month notice period, starting on the first day of the month following the date of termination.
-
Example: if a member gives notice on April 13, the month of May will serve as the notice period and must be fully paid.
-
Any termination after the first day of a month always requires payment of the entire subsequent month.
-

During the notice period, the member may continue to attend training sessions provided that all payments are up to date.
-
Fees already paid, including during the notice period, are non-refundable.

Warisan reserves the right to terminate membership immediately and without notice or refund if:
-
a member's behavior or attitude compromises the safety, atmosphere, or reputation of the Academy; or
-
the member violates the Academy's rules, ethics, or principles.

In all cases where Warisan terminates membership, the financial obligations for the current month remain fully due and payable.
7. Safety, Risk & Liability
-
Participation in all Warisan activities is entirely at the member's own risk.
-
The member acknowledges that martial arts training involves physical exertion and risk of injury.
-
By participating, the member confirms that they are physically and mentally fit to engage in training.
-
Warisan, its instructors, assistants, and affiliates are not liable for any injury, loss, or damage of any kind, regardless of cause, occurring during or outside training hours.

Each participant must use appropriate protective equipment, including but not limited to: safety glasses, groin guards, knee guards, and forearm protectors.
-
Training with weapons (such as knives, bastons, machetes, karambits, sarongs, kapaks, sickles, or other weapons) must always be performed with care, discipline, and supervision.

By accepting these Terms, the member irrevocably waives all rights to pursue legal action or compensation against Warisan or its representatives for any injury, loss, or damage incurred during participation.
8. Equipment & Personal Responsibility

Members are responsible for maintaining their own training equipment, weapons, and protective gear.
-
Use of any equipment provided by Warisan is at the member's own risk.
-
Any damage to Warisan property resulting from negligence or misuse will be charged to the responsible individual.
9. Absence & Holidays
-
If a member decides to take a break or go on vacation, no refunds, credits, or compensation will be issued.
-
Missed classes cannot be transferred, exchanged, or substituted with other sessions.
-
Consistent attendance is required for progression, ranking, and certification.
10. Photography, Video & Media
-
Warisan reserves the right to photograph, film, or record classes, seminars, or events for educational and promotional purposes.
-
By participating, the member grants Warisan a permanent, royalty-free license to use their image, voice, and likeness in any media, online or offline.
-
Members who do not wish to appear in such materials must notify Warisan in writing before participating.
11. Intellectual Property
-
All methods, systems, training materials, logos, names, and programs of Warisan International Martial Arts Academy are intellectual property of Guru Marcel Horstman and Warisan.
-
It is strictly prohibited to copy, share, or teach any content outside the Academy without prior written authorization.
-
Any infringement may result in immediate expulsion and legal action under Dutch copyright and civil law.
12. Amendments
-
Warisan reserves the right to modify or supplement these Terms at any time.
-
Substantial changes will be announced via the Academy's communication channels or website.
-
Continued participation following modification constitutes acceptance of the revised Terms.
13. Governing Law & Jurisdiction
-
These Terms & Training Regulations are governed exclusively by Dutch law.
-
Any dispute arising from these Terms shall be submitted to the competent court in The Hague, The Netherlands, unless mandatory law dictates otherwise.
-
If any provision of these Terms is deemed invalid or unenforceable, all remaining provisions shall remain fully valid and enforceable.
14. Acknowledgment & Acceptance
By enrolling in Warisan International Martial Arts Academy, the member confirms that they have read, understood, and accepted these Terms & Training Regulations.
The member acknowledges that participation is entirely at their own risk and waives any right to hold Warisan, its instructors, or affiliates liable for any injury, loss, or damage of any kind.
15. NPSF Membership
Upon successful completion of the six (6)-week evaluation period and official acceptance as a member of Warisan International Martial Arts Academy, it is mandatory to register with the Dutch Pencak Silat Federation (NPSF) via:

This registration forms part of the official Warisan membership and is required for:
- national recognition of membership;
- eligibility for national and international events or examinations;
- insurance and registration in accordance with NPSF regulations.
- All costs associated with NPSF registration and membership are separate from Warisan tuition fees and are the sole responsibility of the member.
16. Certificate of Conduct (VOG Requirement)
Warisan International Martial Arts Academy prioritizes safety, integrity, and trust within its training environment.
Therefore, all new members are required to submit a valid Certificate of Conduct (VOG) before official acceptance as a member.
No membership can be confirmed without a valid VOG.
In addition, all members, instructors, assistants, and staff must renew their VOG annually, before the expiration date of the previous certificate.
The VOG must be no older than 12 months at the time of submission and must be obtained via the official Dutch government website:

All costs for obtaining or renewing the VOG are the sole responsibility of the applicant and cannot be reimbursed or claimed from Warisan International Martial Arts Academy.
If a (new) member fails or refuses to provide a valid or renewed VOG, Warisan reserves the right to:

deny membership admission;
-
terminate cooperation or training participation;
-
or temporarily suspend access to classes.
All VOG data will be used strictly for internal assessment and processed confidentially in accordance with the GDPR.
17. Administrative & Registration Costs
All administrative, registration, or re-registration costs related to external organizations, federations, or governmental authorities (including the NPSF and Justis for the VOG) are the sole responsibility of the participant and cannot be claimed from Warisan International Martial Arts Academy.
18. Liability for External Institutions
Warisan International Martial Arts Academy shall not be held liable for any delays, errors, or rejections in registration processes handled by external organizations such as the NPSF or Justis.
The responsibility for timely, accurate, and complete submission of required information lies entirely with the participant.
19. Fee Adjustment & Indexation
Warisan International Martial Arts Academy reserves the right to annually adjust or index tuition and participation fees, for example due to rising operational costs or inflation.
Such adjustments do not grant the member any right to cancellation or refund.
20. Membership Modification Policy

Members who wish to change their membership type (for example, from training three times per week to once per week) must submit their request in writing by email to Warisan International Martial Arts Academy.

Membership changes can only take effect from the start of a new billing cycle, which runs from the 23rd of each month to the 23rd of the following month.

Requests submitted after the 23rd will take effect from the next upcoming billing period.

Membership fees will not be recalculated or refunded for any remaining period within the current billing month.
-
The change becomes official only after it has been confirmed by email by the Academy's administration.
21. Health, Safety, and Fitness for Training
Warisan International Martial Arts Academy reserves the right to refuse or terminate membership if, in the judgment of the Head Instructor, a participant is found to have physical, neurological, or psychological conditions or limitations that may pose a risk to their own safety or that of others.
This includes, but is not limited to:

Neurological disorders such as FND, NPH, epilepsy, Parkinson's, MS, ALS, or other conditions affecting the nervous system, balance, or reflexes.
-
Physical limitations such as severe back, hip, knee, or heart conditions, or illnesses that significantly limit mobility, strength, or endurance.
-
Psychological or mental conditions such as PTSD, anxiety disorders, addiction-related issues, or other disorders that impair focus, impulse control, or emotional stability.
The Head Instructor may, at any time and in the interest of safety and wellbeing, suspend or terminate participation.
The Academy may request a medical statement confirming suitability for training.
No refunds of membership fees apply in these cases.
